iHuus Terms of Service

Last Revised on: March 1st, 2026 The website located at ihuus.com, along with our associated APIs, Managed Context Protocol (MCP) servers, maps, and geospatial data services (collectively, the “Site” or “Service”), is a copyrighted work belonging to iHuus, Inc. (“Company”, “us”, “our”, and “we”), a Delaware C-Corporation located at 1111B S Governors Ave STE 37727, Dover DE 19904. These Terms of Service (these “Terms”) set forth the legally binding terms and conditions that govern your use of the Service. By accessing or using the Service, you are accepting these Terms (on behalf of yourself or the entity that you represent). If you do not agree with all of the provisions of these Terms, do not access and/or use the Service. PLEASE BE AWARE THAT SECTION 9 CONTAINS PROVISIONS GOVERNING HOW TO RESOLVE DISPUTES BETWEEN YOU AND COMPANY. AMONG OTHER THINGS, SECTION 9 INCLUDES AN AGREEMENT TO ARBITRATE WHICH REQUIRES, WITH LIMITED EXCEPTIONS, THAT ALL DISPUTES BETWEEN YOU AND US SHALL BE RESOLVED BY BINDING AND FINAL ARBITRATION. SECTION 9 ALSO CONTAINS A CLASS ACTION AND JURY TRIAL WAIVER. PLEASE READ SECTION 9 CAREFULLY.

1. Nature of the Service & Fair Housing Act Compliance

iHuus provides geospatial data infrastructure and neighborhood intelligence. iHuus is a data technology company, not a real estate broker, agent, or financial advisor.
  • For Consumers & Realtors: You agree not to use iHuus data to engage in discriminatory housing practices, steering, or the denial of housing based on race, color, religion, sex, disability, familial status, or national origin.
  • For Developers & Enterprise: If you utilize our API or MCP servers to power AI agents, chatbots, or automated routing systems, you bear sole legal responsibility for ensuring your application’s outputs do not violate the Fair Housing Act or generate biased, discriminatory, or redlining results.

2. Accounts and Registration

  • Account Creation: To use certain features, you must register for an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and API keys.
  • Account Responsibilities: Company cannot and will not be liable for any loss or damage arising from your failure to secure your account or API keys. We may suspend or terminate your Account at any time for any violation of these Terms.

3. Access, API, and MCP Restrictions

The rights granted to you are strictly limited. You agree that you shall not:
  • Scrape or Harvest: Access the Site using robots, spiders, or automated systems to scrape our proprietary Content (including Visual Appeal, Vibe, and Risk indices) to build a competitive database or train external AI models without an Enterprise agreement.
  • Reverse Engineer: Modify, make derivative works of, disassemble, or reverse engineer any part of the Site, API, or our predictive algorithms.
  • Resell Unpackaged Data: Sublicense, sell, or resell raw iHuus data to any third party outside of the authorized white-label or API limits of your specific subscription tier.
  • Abuse MCP / API Limits: You must adhere to the queries-per-second (QPS) and monthly request limits associated with your tier. Note that one LLM call may generate multiple requests to an MCP server; you are responsible for all usage generated by your autonomous agents.

4. Ownership and Intellectual Property

You acknowledge that all intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Service and its Content are owned by iHuus or our suppliers. Providing Feedback or suggestions to us grants iHuus the right to use and exploit such Feedback without restriction or compensation to you.

5. Disclaimers (“As-Is” Clause)

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. COMPANY AND OUR SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. Geospatial data, civic records, and neighborhood intelligence are inherently fluid. We do not guarantee that our data (including flood risks, school ratings, crime indices, or acoustic profiles) is perfectly accurate or up-to-date. iHuus data is a research tool and does not replace professional physical inspections, surveys, or legal due diligence. We are not liable for any financial loss, buyer’s remorse, property damage, or physical harm resulting from your reliance on our data. Certain proprietary metrics, classifications, and indices, including but not limited to Visual Appeal, Neighborhood Vibe, and predictive risk scoring are generated via algorithmic synthesis. These outputs represent subjective estimates and mathematical probabilities, not guaranteed factual conditions. You agree that iHuus cannot be held liable for any detrimental reliance on algorithmic outputs.

6. Limitation on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY (OR OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST COMMISSIONS, PROPERTY DEVALUATION, LOST DATA, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS WILL AT ALL TIMES BE LIMITED TO A MAXIMUM OF FIFTY US DOLLARS ($50.00) OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.

7. Indemnification

You agree to indemnify and hold Company (and its officers, employees, and agents) harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of applicable laws, specifically including the Fair Housing Act or related state anti-discrimination laws.

8. Term, Termination, and The “Kill Switch”

We may suspend or terminate your rights to use the Service (including revoking API keys and MCP access) at any time, for any reason, at our sole discretion. This specifically includes immediate termination without refund if we detect your application using our data for illegal purposes or generating malicious AI behavior.

9. Dispute Resolution and Arbitration

Please read this Arbitration Agreement carefully. It limits the manner in which you can seek relief.
  • Binding Arbitration: Any dispute between you and iHuus relating in any way to the Service or these Terms will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court. The Federal Arbitration Act governs this agreement. The arbitration will be conducted by JAMS.
  • Informal Resolution: Before commencing arbitration, you agree to engage in a good-faith Informal Dispute Resolution Conference by contacting us at contact@ihuus.com. You must give us 45 days to resolve the issue before filing a claim.
  • Waiver of Class Action and Jury Trial: YOU AND COMPANY WAIVE ANY CONSTITUTIONAL RIGHT TO A JURY TRIAL. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS.
  • Batch Arbitration: If 100 or more similar Requests for Arbitration are filed by the same law firm or organization within a 30-day period, JAMS shall administer the demands in batches of 100 to ensure efficient resolution and limit frivolous mass-action fees.
  • 30-Day Opt-Out: You have the right to opt out of this Arbitration Agreement by sending written notice to contact@ihuus.com within 30 days of first accepting these terms.

10. General Provisions

  • Governing Law: These Terms shall be governed by the laws of the State of Delaware, without giving effect to any conflict of laws principles. Any disputes exempt from arbitration shall be litigated exclusively in the state or federal courts located in Delaware.
  • Export Control: The Service is subject to U.S. export control laws. You agree not to export or utilize our technical data in any embargoed countries.
  • California Residents: If you are a California resident, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Product of the California Department of Consumer Affairs in writing at 400 R Street, Sacramento, CA 95814, or by telephone at (800) 952-5210.
  • Electronic Communications: You consent to receive communications from us electronically, and agree that all notices and disclosures provided electronically satisfy any legal requirement that such communications be in writing.
